Kate Aguiar focuses her practice on auto liability defense, premises liability, general litigation, and insurance defense.
The defense of motor vehicle claims is the largest part of her practice. She handles both first party and third party matters, ranging from minor collisions to more complex accidents involving high value injuries. She also manages auto accidents where one party is alleged to be driving under the influence (DUI) of alcohol.
Ms. Aguiar is experienced in handling auto accident claims involving “Maintenance of Traffic” (MOT) plans. Road construction contractors typically prepare and file an MOT when working on projects that require redirecting traffic around a highway or roadway job site. When an accident occurs, opposing counsel often asserts that the contractor was negligent in the design or implementation of the MOT for the road construction project.
She has developed an interest in the legal aspects of traumatic brain injury (TBI) resulting from personal injury claims, including auto accidents and slip / trip and fall matters. Realizing that opposing counsel often alleges traumatic brain injury as an outcome of an accident, Ms. Aguiar has gained an understanding of how to work with medical experts in defense of a TBI claim. When needed, she consults with neuropsychologists and independent medical examiners to evaluate medical records for evidence of a concussion or other brain injury.
Prior to joining the firm, Ms. Aguiar worked on claims involving rideshare companies. During this time, she gained an understanding of the complexity of insurance disputes that can arise between the rideshare company, their drivers, and any excess and surplus (E&S) insurance company.
Ms. Aguiar also defends a range of premises liability claims alleging slip, trip and fall accidents as well as negligent security.
Early in her legal career Ms. Aguiar practiced immigration and family law. She then took a break from the law while having two children, now aged 5 and 8. When she returned to her law practice in 2015, she chose to refocus on civil litigation and insurance defense law.
Ms. Aguiar majored in Hispanic Language and Literature at Boston University and is fluent in Spanish. She spent a summer in Spain as an exchange student at age 16 and later worked as an English teacher in Ecuador.
She attributes much of her success to a strong work ethic and thorough attention to detail. She works closely with clients in an effort to build a trusting business relationship.
In her spare time Ms. Aguiar enjoys activities with her family and their pets and is a fitness enthusiast.
