Appellate Team Obtains a Writ of Certiorari

March 19, 2020 by on News

Kansas R. Gooden and Geneva R. Fountain obtained a writ of certiorari on behalf of a client.  The county court refused to order appraisal when it was mandated by the insurance policy.  The trial counsel had presented binding case from a District Court of Appeal.  However, the county court refused to apply the case law and stated that it was not required to follow it.  The Boyd & Jenerette Appellate Team filed an immediate petition for writ of certiorari to the circuit court sitting in its appellate capacity.  The circuit court explained that the county court was bound by the District County decision and its refusal to comply, was a departure of the essential requirements of the law.
