Boyd & Jenerette Defends National Insurance Carrier in Bad Faith Trial

The Boyd & Jenerette bad faith trial team successfully defended a major insurance company in Duval County Circuit Court against allegations of bad faith in handling a property claim involving damage to a Lotus sports car. Attorneys Jane Anderson and Randy Dow tried the case to a jury over seven days.

The plaintiff argued that the carrier acted in bad faith by failing to pay him the total loss value of the Lotus prior to the time that it did. The plaintiff also sought punitive damages, alleging that the carrier acted in the same manner as a general business practice.

The defense team argued that a judgment in the underlying case was procured by misrepresentations of fact. Further, the defense argued that the insured failed to cooperate with the carrier’s investigation and that the carrier attempted to settle the case multiple times. The jury found that the carrier did not act in bad faith.
