Boyd & Jenerette Partner Suzanne Villa Secures Dismissal for Client in Auto Liability Claim

Boyd & Jenerette Partner Suzanne Villa recently obtained a dismissal for our client when the Court granted a Motion to Dismiss. The co-defendant chose to not waive subrogation against the insured for the sole purpose of having the tortfeasor/insured at trial. If the judge had not granted the Motion to Dismiss, we would have been forced to defend our client at trial at great expense to the carrier.

However, if the motion was denied, it would’ve had a chilling effect on future settlements. Tortfeasors and the insurance carrier would think twice about tendering in similar situations. The carrier, in this case, did not feel the case was worth the 100k tender, but they made a business decision to do so. If the motion had been denied, UM carriers would never waive subrogation and always want the tortfeasor to stay in the case, throughout the case and in trial. Thus, backing up the court dockets more than they currently are and insurance carriers incurring more costs.
