Boyd & Jenerette Trial Team Achieve Defense Verdict in Property Damage Case

May 14, 2021 by on News

Boyd & Jenerette’s Property Damage team obtained a defense verdict on behalf of a major insurance carrier in a jury trial in April. The trial team consisted of Kristen Van der Linde and Kat Oughton. The trial took place in Flagler County and was Boyd & Jenerette’s second post-COVID jury trial (both resulting in defense verdicts).

Plaintiff and her public adjuster argued that her property was damaged as a result of a hailstorm and if successful, would have been entitled to costs to repair her property as well as her attorney’s fees. Instead, the jury agreed with the insurance company that the property was not damaged by the hailstorm. Due to Plaintiff’s refusal of a reasonable offer to settle, the insurance company is now entitled to its fees and costs.
