Dismissal of Negligence Charges in Reporting a Crime

In a 2019 state court matter, the plaintiff filed a voluntary dismissal with prejudice on the eve of a hearing on the firm’s motion for summary judgment. The defendant was a Florida franchisee of a national restaurant chain. The firm represented the defendant under a relatively new cause of action for “negligence for incorrect reporting of crime,” which also involved a related criminal matter concerning the purchase of food for delivery using stolen credit cards.

The firm established through discovery that the defendant was correct in reporting the suspected criminal activity and that there was no punitive or reckless conduct on the part of the defendant. Courtney Momberg Johnson was the lead attorney.
