Appellate Case Law Update – Motions for Extension of Time to Response to PFS Do Not Automatically Toll Time

The Supreme Court of Florida recently held that “a motion to enlarge does not toll the time to accept a proposal for settlement.” Koppel v. Ochoa, No. SC16-1474, 2018 Fla. LEXIS 1091, *1 (Fla. May 17, 2018). This Opinion comes after multi-District conflict on the impact of a motion for enlargement of time to respond to proposals for settlement served under Rule 1.442. Appellate Case Law Update – Aggravation of Injury Instruction Inappropriate Where the Defense Only Introduces Evidence of a Preexisting Injury to Dispute Causation

The Fourth District Court of Appeal recently found improper a jury instruction concerning aggravation of a preexisting condition where no evidence had been presented at trial to support that instruction. Sanchez v. Martin, 4D17-1731 (Fla. 4th DCA, June 6, 2018). In this personal injury accident action arising out of an auto accident, the Plaintiff introduced evidence that his injuries were caused entirely from the accident. Kevin D. Franz Appointed to The Florida Bar’s Professional Ethics Committee

Kevin D. Franz was appointed to serve on The Florida Bar’s Professional Ethics Committee beginning July 1, 2018 by the President-Elect of The Florida Bar, Michelle R. Suskauer.   The Professional Ethics committee is charged with the duty of answering ethics inquiries from members of the Bar concerning the inquirer’s own proposed conduct. The committee reviews informal advisory opinions issued by Florida Bar ethics department attorneys. The Second District Court of Appeal has again certified conflict with the Fourth District as to whether a motion for sanctions pursuant to section 57.105, Florida Statutes, which requires the party moving for sanctions to serve the motion for sanctions but not file the motion until a “safe harbor” twenty-one-day period has run without the challenged issue being withdrawn or corrected, must comply with the email service requirements of Florida Rule of Judicial Administration 2.516. Appellate Case Law Update – Joint Proposals for Settlement

In Pacheco v. Gonzalez, 43 Fla. L. Weekly D1084b (Fla. 3d DCA May 16, 2018), the appellants challenged a final judgment for attorneys’ fees based on a Proposal for Settlement served pursuant to section 768.79, Florida Statutes (2011), and Florida Rule of Civil Procedure 1.442.
