She spoke on “The Impact of Medical Marijuana in Workers’ Compensation Claims and in the Workplace.”  Linda’s panel also included Kevin Glennon, RN, BSN, CDMS, CWCP, QRP, Vice President of Clinical Programs at One Call Care Management. Boyd & Jenerette Wins Workers’ Compensation Appeal

The First District Court of Appeal recently issued a per curiam affirmance opinion in favor of our client.  The Claimant had alleged that her carpal tunnel injury was related to her work.   Several doctors initially found it was related; however, after viewing a video showing the Claimant’s work duties, the doctors changed their opinions.  The JCC followed the opinions of those doctors and found that the injury was not related, and therefore, not compensable.  The Claimant challenged this ruling on appeal arguing that the video invalidated their opinions and was […]

Insurance Coverage & Bad Faith Case Law Update – The Florida Supreme Court Holds the Application of a Contingency Fee Multiplier to an Award of Attorney’s Fees to a Prevailing Party is not Limited to “Rare” and “Exceptional” Circumstances

In Joyce v. Federated National Insurance Company, No. SC16-103 (Fla. Oct. 19, 2017), the Court addressed the issue regarding whether a contingency fee multiplier can be applied to an attorney’s fee award to a prevailing party only in “rare” and “exceptional” circumstances.  The trial court applied a 2.0 contingency fee multiplier to the award of attorney’s fees to the insureds that prevailed in action against their homeowners’ insurance carrier.  The insureds sought to recover fees under section 627.428, Florida Statutes.  Relying on Standard Guar. Appellate Case Law Update – Does Improper Service Invalidate Proposals for Settlement?

The Supreme Court of Florida recently accepted jurisdiction in Wheaton v. Wheaton, Case No. SC17-716, to review a conflict among the District Courts regarding whether a party is required to strictly comply with the service requirements set forth in Florida Rule of Judicial Administration 2.516 in order to enforce a proposal for settlement.  In Wheaton v.
