Appellate Team Prevails in Two Appeals on Forum Non Conveniens

The firm recently scored appellate wins in a pair of related PIP cases involving transfer of venue for inconvenient forum. Unlike the typical PIP case, these cases involved allegations of fraud that required fact witnesses. The trial court granted Defendant’s motions to transfer venue to the county where the auto accident occurred and the witnesses were located. On appeal, the Plaintiff-Appellants challenged the sufficiency of the affidavit supporting transfer and argued their choice of venue was appropriate. Voicemails Seeking Clarification Deemed Rejection and Counteroffer of Time-Limited Demand in Georgia

In a recent decision, the Georgia Court of Appeals held that the act of an insurance company leaving a voicemail to seek clarification was in fact a rejection and counteroffer of the claimant’s time-limited O.C.G.A. § 9-11-67.1 demand.  White v.
