Appellate Team Prevails in Two Appeals on Forum Non Conveniens

September 27, 2021 by on News

The firm recently scored appellate wins in a pair of related PIP cases involving transfer of venue for inconvenient forum. Unlike the typical PIP case, these cases involved allegations of fraud that required fact witnesses. The trial court granted Defendant’s motions to transfer venue to the county where the auto accident occurred and the witnesses were located. On appeal, the Plaintiff-Appellants challenged the sufficiency of the affidavit supporting transfer and argued their choice of venue was appropriate. The appellate court rejected these arguments and affirmed the transfer in both cases. The appeals were handled by Kansas Gooden and Joanna Brunell.
