Boyd & Jenerette Wins Workers’ Compensation Appeal

The First District Court of Appeal recently issued a per curiam affirmance opinion in favor of our client.  The Claimant had alleged that her carpal tunnel injury was related to her work.   Several doctors initially found it was related; however, after viewing a video showing the Claimant’s work duties, the doctors changed their opinions.  The JCC followed the opinions of those doctors and found that the injury was not related, and therefore, not compensable.  The Claimant challenged this ruling on appeal arguing that the video invalidated their opinions and was not competent, substantial evidence.  Ben Samuels litigated the case before the JCC and Kansas R. Gooden handled the appeal.
