Kansas Gooden and Lara Edelstein Prevail in Appeal of Declaratory Judgment

Kansas Gooden and Lara Edelstein prevailed in an appeal involving a declaratory action in the First District Court of Appeal.  The case involved a work-related injury.  The insurance carrier sought a declaratory judgment that the worker’s bodily injury claims were excluded from coverage based on two exclusions in the policy.  The carrier alleged it had no duty to indemnify or defend the employer for the accident with respect to the injured worker’s personal injury lawsuit.  The trial court agreed that one of the exclusions applied as a matter of law […]

Boyd & Jenerette Obtains Writ of Certiorari In Bad Faith Case

The case arises out of an automobile accident which resulted in a jury verdict of approximately $44 million.  The underlying trial court remitted the verdict to $22 million, and no appeal was sought.  The Estate filed a bad faith suit for failing to settle and for breaching its duty to defend.  During the litigation, the trial court ordered production of the personnel files of numerous adjusters, high-ranking claims executives, the bad faith adjuster, and home office attorneys.  Kansas filed a petition for writ of certiorari on behalf of the carrier […]

On April 28, 2022, the Florida Supreme Court issued its opinion in Dial v. Calusa Palms 337 So. 3d 1229 (Fla 2022) which confirmed and hopefully ended the issue of the correct amount that can be “boarded” for past medical expenses when Medicare has paid the past medical bills.
