After the Plaintiff voluntarily dismissed its subrogation case, the Defendants moved for prevailing party attorney’s fees. Kansas Gooden and Kevin Franz successfully defended an appeal by a Plaintiff in an auto accident case following a jury verdict.  The jury awarded $150,000 in past medical expenses, nothing in future medical expenses, and did not find permanency.  Plaintiff objected before the jury was discharged arguing the verdict was inconsistent.  Specifically, Plaintiff argued the no permanency finding was inconsistent with the past medical expense award, which according to Plaintiff, necessarily included amounts for a prior permanent surgical procedure.
