Boyd & Jenerette Appellate Win on Prevailing Party Attorney’s Fees

Kansas Gooden and Lara Edelstein recently prevailed in an appeal in the Fourth District Court of Appeal. After the Plaintiff voluntarily dismissed its subrogation case, the Defendants moved for prevailing party attorney’s fees. The trial court agreed with the Plaintiff that the Defendants were not entitled to prevailing party attorney’s fees under section 718.303, Florida Statutes because there was minimal litigation and no ruling on a dispositive issue. Kansas Gooden and Kevin Franz successfully defended an appeal by a Plaintiff in an auto accident case following a jury verdict.  The jury awarded $150,000 in past medical expenses, nothing in future medical expenses, and did not find permanency.  Plaintiff objected before the jury was discharged arguing the verdict was inconsistent.  Specifically, Plaintiff argued the no permanency finding was inconsistent with the past medical expense award, which according to Plaintiff, necessarily included amounts for a prior permanent surgical procedure.
