Boyd & Jenerette Appellate Win on Prevailing Party Attorney’s Fees
May 6, 2024 by boydjenerette on News
Kansas Gooden and Lara Edelstein recently prevailed in an appeal in the Fourth District Court of Appeal. After the Plaintiff voluntarily dismissed its subrogation case, the Defendants moved for prevailing party attorney’s fees. The trial court agreed with the Plaintiff that the Defendants were not entitled to prevailing party attorney’s fees under section 718.303, Florida Statutes because there was minimal litigation and no ruling on a dispositive issue.
On appeal, the Fourth District reversed the trial court’s order. In its decision, the Court held that the trial court abused its discretion by not applying the general rule that a defendant is the prevailing party when a plaintiff voluntarily dismisses the case. No exceptions to the general rule applied in this case because the Defendants did not pay almost all of the damages demanded by the Plaintiff before the dismissal. Nor did the Defendants do anything to moot the Plaintiff’s cause of action. The Court remanded for a determination as to the amount of Defendants’ attorney’s fees.

Ms. Gooden also currently serves on the Florida Bar’s Board of Legal Specialization and Education. This committee oversees the certification committees and CLE accreditation for the bar. She previously served on and chaired the Florida Bar’s Appellate Board Certification Committee, which writes and grades the appellate board certification test. The examination tests an applicant’s knowledge of state and federal appeals in the areas of civil, criminal, administrative, worker’s compensation, probate, and family law.
