Payton D. Bramlett recently obtained summary judgment in a side-swipe automobile collision case in Coweta County Superior Court, where plaintiff was represented by counsel.  In her complaint, plaintiff claimed that defendant was negligent in changing lanes in violation of O.C.G.A. § 40-6-123 and that defendant committed battery to the person of the plaintiff in violation of O.C.G.A. § 51-1-13.  Plaintiff also claimed that defendant had been stubbornly litigious in violation of O.C.G.A. § 13-6-11.  Chief Judge John Simpson entered a dispositive order granting defendant’s motion for summary judgment on all […]

Attorney Brooke DiSalvo recently obtained a dismissal with prejudice due to a Plaintiff’s fraud upon the court. The suit was brought following a motor vehicle vs. bicycle collision which resulted in the vehicle’s driver being sued for automobile negligence in Bay County, Florida. The Plaintiff bicyclist claimed resulting head, neck, back, leg, and knee injuries. Expiration Dates on Settlement Checks and Precise Delivery Dates: New Impediments to Time-Limited Demand Responses in Georgia

In a June 28, 2023 opinion, a three-judge panel of the Georgia Court of Appeals held that the act of including an expiration date on a settlement check will be construed as a rejection and counteroffer if a claimant’s demand includes a prohibition on “expirations.”  Pierce v.
