Boyd & Jenerette Appellate Win Affirming Jury Verdict and Denial of Motion for New Trial
July 5, 2024 by boydjenerette on News
Kansas Gooden and Lara Edelstein recently defended a defense verdict on appeal in an automobile negligence case.
On appeal, the Plaintiff argued that the trial court abused its discretion by denying her motion for new trial for several reasons. However, the jury’s verdict was supported by competent substantial evidence. The medical opinions of the Defendant’s experts were in sharp contrast to those of the treating physicians. None of the defense experts concluded that Plaintiff’s injuries were caused by the accident.
Plaintiff’s argument that the defense counsel’s closing argument was improper was not preserved for appellate review where Plaintiff failed to object to the complained of argument. Nonetheless, Plaintiff failed to establish fundamental error because the argument was a fair comment on the evidence.
The Fifth District Court rejected the Appellant’s arguments and issued an opinion affirming the final judgment without a written opinion.
