Boyd & Jenerette Associate Brooke DiSalvo Recently Obtained Final Summary Judgment
March 15, 2023 by boydjenerette on News
Brooke DiSalvo, an associate in the firm’s Jacksonville office, recently obtained a final judgment in favor of a construction company and its owner who were sued for wrongful death arising out of a construction site accident in Bay County, Florida.
The Plaintiff alleged that the company and its owner were liable for the death because the owner informed the decedent of the construction job and loaned the decedent construction supplies on the day before the accident. It was undisputed that the construction company owner was not present on the job site at any time. Additionally, the construction company owner provided an affidavit confirming that he withdrew from the project before work began due to a material misrepresentation of the project’s details provided by the roofing subcontractor.
Ms. DiSalvo successfully argued that the construction company and its owner were not liable because they were not present on the job site, did not employ the decedent, and had no control over the construction site.
