Statutory Updates – Civil Remedy Notice of Insurer Violation / Change in Appellate Jurisdiction

Effective July 1, 2020, a Civil Remedy Notice of Insurer Violation must be provided by the Department of Financial Services to the e-mail address designated by the affected insurer. No bad faith action shall lie “if, within 60 days after the insurer receives notice from the department in accordance with this subsection, the damages are paid or the circumstances giving rise to the violation are corrected.” Prior to the amendment, there was no requirement that the department send the Civil Remedy Notice to the insurer. Southern District Court Rules that Non-Specific Civil Remedy Notices are Invalid

In Pin-Pon Corp. v. Landmark American Insurance Company, 2020 U.S.Dist. LEXIS 100072 June 5, 2020), Judge Middlebrooks ruled that the Plaintiff had failed to satisfy a condition precedent to filing a statutory bad faith action and dismissed the Plaintiff’s bad faith complaint. The Plaintiff suffered losses in Hurricane Frances and filed claims against Landmark. Suit was filed by the Plaintiff and resulted in a judgment for $2,935,642.37.
