Florida Workers’ Comp Litigation Slows Due to COVID-19

David Langham, the Deputy Chief Judge of Compensation Claims for the Florida Office of Judges of Compensation Claims and Division of Administrative Hearings, writes in a June 18, 2020 blog post that “litigation is slowing.” Workers’ compensation petition filings for “new cases” filed with the Florida OJCC had been increasing in fiscal 2020 (started July 1, 2019), according to the Judge. Florida Issues 2020 COVID-19 Workers’ Compensation Report

The Florida Division of Workers’ Compensation recently issued a “2020 COVID-19 Report” with a data summary through May 31, 2020. From January 1, 2020 through May 20, 2020, COVID-19 indemnity claims numbered 3,807, or 15 percent of the total of all 25,449 indemnity claims during that time period. The total benefits paid (indemnity and medical) were $3.43 million for the COVID claims and $118.02 million for all claims. Shareholder Kansas Gooden and partner Kevin Franz successfully defended against an appeal brought by a plaintiff in a wrongful death action where the trial court ruled that the owner of the vehicle involved in the accident was limited to $100,000 in liability. The case arose out of a fatal accident where an estate of the decedent sued the vehicle’s owner as well as his stepson who was driving the vehicle.
